These Terms of Service govern your use of this website and any purchase you make from it. This website is operated by Swiss-Link, Inc., a California corporation doing business as Wavian USA ("we," "us," "our"). By using this site or placing an order, you agree to these terms.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. You agree that the information you provide at checkout is accurate and that you are authorized to use the payment method presented.

2. Products, pricing, and availability

Prices are shown in US dollars and may change without notice. We make reasonable efforts to display products, specifications, and stock accurately, but listings may contain errors and colors may vary by screen. We reserve the right to correct errors, limit order quantities, refuse or cancel any order, and discontinue any product. If we cancel an order you have already paid for, we refund it in full.

3. Orders and acceptance

Your order is an offer to buy. Our acceptance occurs when we dispatch the order. An order confirmation email acknowledges receipt but does not constitute acceptance. If a product is listed at an incorrect price or with an incorrect description, we may cancel the order and refund payment even after confirmation.

4. Payment and taxes

Payment is processed at checkout by our payment providers. Applicable sales tax is calculated at checkout based on the shipping destination. You are responsible for any duties, import taxes, or customs fees on shipments outside the United States.

5. Shipping, returns, and refunds

Shipping terms are set out in our shipping policy. Return, refund, and cancellation terms are set out in our refund policy. Both are incorporated into these terms by reference.

6. Product use, safety, and compliance

Fuel containers are functional equipment intended for the storage and transport of fuel by users who understand the associated risks. You are solely responsible for using our products in compliance with all applicable federal, state, and local laws, including fire codes, storage-quantity limits, and transport regulations. Never store fuel indoors near ignition sources, never fill a can inside a vehicle, ground the can when filling, and follow all markings and instructions on the product. Product specifications, standards references, and educational content on this site are provided for information only and are not a substitute for the regulations that apply to you.

7. Warranty

Our products are covered by the manufacturer-defect terms in our refund policy. Except as stated there and as required by law, products are provided "as is" without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Misuse, modification, alteration, normal wear, cosmetic marks from use, damage from improper storage, and use of a container with a substance it was not designed for are not covered.

8. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to any product or your use of this site is limited to the amount you paid for the product at issue. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or property damage, however caused. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

9. Intellectual property

The Wavian name and logo, this site's content, photography, product copy, and layout are owned by Swiss-Link, Inc. or its licensors and are protected by intellectual property laws. You may not copy, reproduce, republish, or use them commercially without our written permission. Third-party marks and embedded third-party media remain the property of their respective owners.

10. Acceptable use

You agree not to use this site to violate any law, to interfere with its operation or security, to collect data by automated means without permission, to submit false information, or to reproduce our catalog for resale without an authorized wholesale agreement.

11. User submissions

If you submit reviews, photos, questions, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business. You confirm you own or are permitted to share what you submit. We may remove any submission at our discretion.

12. Third-party links and services

This site links to and embeds third-party content and relies on third-party services, including our ecommerce platform and payment processors. We are not responsible for third-party content, terms, or privacy practices.

13. Wholesale and resale

Orders placed on this site are for end use. Resale, dealer, and distributor purchases are governed by a separate written wholesale agreement with Swiss-Link, Inc. We may cancel retail orders that appear to be for unauthorized resale.

14. Privacy

Our handling of personal information is described in our privacy policy.

15. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Butte County, California, and you and we consent to that jurisdiction and venue.

16. Changes

We may update these terms at any time. The version posted at the time of your order applies to that order. Continued use of the site after changes are posted constitutes acceptance of the revised terms.
